Notice of License Application Pursuant to M. G. L. Chapter 91 Waterways License Application Number 23-WW01-0079-APP
Little Moth Properties Real Estate Trust
NOTIFICATION DATE: March 21, 2024

Public notice is hereby given of the waterways application by Little Moth Properties Real Estate Trust to construct and maintain a pier, ramp and float at 7 Cedar Avenue in the municipality of Dartmouth, in and over the waters of the Slocum River. The proposed project has been determined to be water-dependent.
The Department will consider all written comments on this Waterways application received within 30 days subsequent to the “Notification Date”. Failure of any aggrieved person or group of ten citizens or more, with at least five of the ten residents residing in the municipality(s) in which the license or permitted activity is located, to submit written comments to the Waterways Regulation Program by the Public Comments Deadline will result in the waiver of any right to an adjudicatory hearing in accordance with 310 CMR 9.13(4)(c).

Notice is hereby given under M.G.L. Chapter 40A, Section 5 (The Zoning Act) of a PUBLIC HEARING to be held at 7:00 p.m. on Monday, April 8, 2024. The Planning Board voted in a Public Meeting to continue meeting virtually in accordance with the governor’s 2023 extension of the virtual/hybrid open meeting option through March 31, 2025. The hearing concerns warrant articles for the June 4, 2024, Dartmouth Town Meeting.

Article A: ACCESSORY DWELLING UNITS
To see if the Town will vote to delete §§ 375-7.2D, 375-8.2D, 375-9.2D and 375-10.2E of the Zoning Bylaw.

And further, to delete all reference to off-street parking requirements for accessory apartments in each of §§ 375-7.4G(1), 375-8.4G(1), 375-9.4G(1) and 375-10.4G(1) of the Zoning Bylaw.

And further, to amend the Use Table in § 375-5.1 of the Zoning Bylaw by deleting the “Accessory Apartment” use and replacing it with an “Accessory Dwelling Unit” use, and by having this use be listed as “NP” for all zoning districts except for SRA, SRB, SRC and GR, which four districts shall have the use be listed as “P”.

And further, to delete both the term “Accessory Apartment” and its definition in § 375- 5.3B and replace it with the term “Accessory Dwelling Unit” with the following definition: “A separate residential unit that has its own cooking, sanitary and sleeping facilities, and that is attached to, clearly subordinate to, and has a means of external ingress and egress that is separate from, a principal residential unit.”

And further, to amend the definition for “Accessory Building with Utilities” in § 375- 5.3B by adding the following language after a comma at the end of the existing language: “but exclusive of any building or structure intend for, or utilized as, a dwelling unit, lodging unit or residential unit.”

And further, to amend the definition for “Detached Accessory Structure” in § 375-5.3B by adding the following language after a semicolon at the end of the existing language: “further provided, that such building or structure shall not be used as a dwelling unit, lodging unit or residential unit.”

And further, to create a new Article 50 of the Zoning Bylaw, to be entitled “Accessory Dwelling Units”.

Article B: MINIMUM LOT AREA
To see if the Town will vote to delete Article 30 (§375-30) of the Zoning By-Law, dealing with “Minimum Lot Area” in its entirety and replace.

Article C: FRONTAGE
To see if the Town will vote to delete Article 31 (§375-31) of the Zoning By-Law, dealing with “Frontage” in its entirety and replace.

Article D: PERCENTAGE OF LOT COVERED
To see if the Town will vote to delete Article 32 (§375-32) of the Zoning By-Law, dealing with “Percentage of Lot Covered” in its entirety and replace.

Article E: SETBACKS
To see if the Town will vote to delete Article 33 (§375-33) of the Zoning By-Law, dealing with “Setbacks” in its entirety and replace.
